Please read these Terms and Conditions ("Terms") carefully before using the services, website, or programs offered by Finder Squad LLC ("Company," "we," "us," or "our"). By engaging our services, accessing our website, or signing a coaching agreement, you ("Client," "you," or "your") agree to be bound by these Terms.
If you do not agree with any part of these Terms, please do not use our services or website.
1. About Finder Squad LLC
Finder Squad LLC is a performance coaching and consulting company headquartered in Fort Wayne, Indiana. We help mid-level managers and VPs who have hit an invisible ceiling discover exactly how they are wired and build a deployable leadership identity so that they earn the advancement, own their influence, and become the leader their organization cannot afford to lose.
Our services include, but are not limited to, individual and group performance coaching, leadership development programs, CliftonStrengths assessments and debriefs, organizational consulting, and keynote speaking engagements.
2. Services Offered
2.1 Coaching Programs
Finder Squad LLC offers the following primary coaching programs:
• Finder Growth — A six-month, one-on-one performance coaching engagement.
• Finder Elite — A comprehensive coaching engagement that includes 360-degree feedback, stakeholder integration, and organizational alignment.
Program deliverables, timelines, session frequency, and investment amounts are described in the applicable Coaching and Coachee Agreement signed by both parties at the commencement of each engagement.
2.2 Additional Services
We also provide leadership training, cohort programs, organizational training, keynote speaking, and CliftonStrengths coaching. The scope and terms of these engagements are governed by separate written agreements as applicable.
3. Eligibility
Our services are intended for working professionals and organizations. By engaging our services, you represent and warrant that:
• You are at least 18 years of age.
• You have the legal authority to enter into agreements on behalf of yourself or, where applicable, your organization.
• All information you provide to us is accurate and complete.
4. Fees, Payment, and Refund Policy
4.1 Fees
Coaching program fees are outlined in your Coaching and Coachee Agreement or applicable proposal. All fees are due pursuant to the payment schedule specified in that agreement.
4.2 Payment Methods
We accept payment by the methods specified in your agreement, which may include credit card, ACH transfer, or check. Corporate clients may be subject to separate invoicing terms.
4.3 Late Payments
Payments not received by the agreed due date may result in a temporary suspension of services until the account is brought current. Finder Squad LLC reserves the right to charge a late fee or interest on overdue balances as specified in your agreement.
4.4 Refund Policy
All fees paid are generally non-refundable once a coaching engagement has commenced. If you must discontinue participation prior to the completion of an engagement, please notify us in writing. Any consideration of pro-rated refunds or credits is at the sole discretion of Finder Squad LLC and will be evaluated on a case-by-case basis.
Cancellation of a scheduled session with less than 24 hours notice may result in forfeiture of that session at Finder Squad LLC's discretion.
5. Intellectual Property
All content, frameworks, methodologies, tools, worksheets, presentations, written materials, training content, and branded deliverables provided by Finder Squad LLC — including the Finder Leader System™, the S.T.R.O.N.G. Framework™, the 5 Qualities of Growth, the Dial and Deploy™ concept, and all associated programs and materials — are the exclusive intellectual property of Finder Squad LLC and Barry Schrock.
You are granted a limited, non-exclusive, non-transferable license to use materials provided to you solely for your own personal development within the scope of your coaching engagement. You may not:
• Reproduce, distribute, or publish any Finder Squad materials for commercial or non-commercial purposes without prior written consent.
• Use any Finder Squad frameworks, tools, or methodologies to coach, train, or advise others, whether for compensation or not.
• Claim ownership of or register any Finder Squad intellectual property.
Violation of this section may result in termination of your engagement and legal action.
6. Confidentiality
6.1 Client Information
Finder Squad LLC takes confidentiality seriously. Information shared by you during coaching sessions or through assessments will not be disclosed to third parties except as required by law or as expressly authorized by you in writing.
6.2 Corporate Sponsor Disclosure
If your coaching engagement is sponsored or funded in whole or in part by your employer or a third-party organization ("Corporate Sponsor"), we may be required to provide limited progress updates or engagement status information to an agreed-upon stakeholder, such as a manager or HR business partner. The specific scope of any such disclosure will be defined in your Coaching and Coachee Agreement.
6.3 Coaching Records
Session notes and assessments are held in confidence. You may request a summary of your coaching records at any time. Finder Squad LLC retains the right to maintain its own records for professional and business purposes.
7. No Professional Licensure Representations
Coaching is distinct from licensed mental health therapy, counseling, psychiatry, or medical services. Finder Squad LLC does not provide and these Terms do not contemplate the provision of any licensed mental health, medical, financial, or legal advice.
If you are experiencing a mental health crisis or require clinical support, please contact a licensed mental health professional or emergency services.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Finder Squad LLC, its founders, employees, coaches, and contractors shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from or related to your use of our services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total fees paid by you to Finder Squad LLC in the three (3) months immediately preceding the event giving rise to the claim.
9. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee specific outcomes, including career advancement, promotion, salary increases, or organizational changes resulting from participation in our coaching programs.
Results depend on your individual effort, engagement, and circumstances, which are beyond our control.
10. SMS and Electronic Communications
By providing your mobile phone number to Finder Squad LLC, you consent to receive SMS text messages from us. We use SMS messaging primarily as a tool to remind clients of appointment times and upcoming meetings.
Message frequency will vary. Standard message and data rates may apply depending on your mobile carrier and plan. You may opt out of SMS communications at any time by replying STOP to any message we send. For assistance, reply HELP or contact us at [email protected].
We do not share your mobile number with third parties for marketing purposes.
11. Website Use
Access to and use of FinderSquad.com is subject to these Terms. You agree not to:
• Use the website for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any part of the website or its underlying systems.
• Transmit any harmful, offensive, or disruptive content through any feature of the website.
We reserve the right to modify, suspend, or discontinue the website or any portion thereof at any time without notice.
12. Third-Party Links and Services
Our website and communications may contain links to third-party websites, tools, or services (including but not limited to scheduling platforms, assessment providers, and payment processors). We are not responsible for the content, privacy practices, or terms of those third parties. Your use of any linked third-party service is governed by that third party's terms and policies.
13. Termination
Either party may terminate a coaching engagement by providing written notice as specified in the applicable Coaching and Coachee Agreement. Finder Squad LLC reserves the right to terminate services immediately and without refund if:
• You engage in abusive, threatening, or harassing behavior toward any Finder Squad employee or contractor.
• You materially breach any provision of these Terms or your Coaching and Coachee Agreement.
• You use Finder Squad proprietary materials in an unauthorized manner.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or our services shall be resolved through good-faith negotiation between the parties. If negotiation fails, disputes shall be submitted to binding arbitration administered in Allen County, Indiana, under rules mutually agreed upon by the parties, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction without first submitting to arbitration.
15. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Material changes will be communicated to active clients by email at the address on file. Your continued use of our services following notice of changes constitutes your acceptance of the updated Terms.
We encourage you to review these Terms periodically.
16. Entire Agreement
These Terms, together with your Coaching and Coachee Agreement and any other written agreements between you and Finder Squad LLC, constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior understandings, representations, or agreements.
